Official Rules

YOU HAVE NOT YET WON. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PLAY THE INSTANT GAME OR TO CLAIM A PRIZE. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The UPS Store® Perks and Paydays Instant Win Game ("Game") is offered at participating locations of The UPS Store® in each of the United States and the District of Columbia. Game is void where prohibited and is subject to all applicable federal, state and local laws and regulations.

1. GAME PERIOD. Game begins on March 1, 2010 and ends March 27, 2010. Game Cards are scheduled to be available until March 27, 2010 or when supplies exhaust, whichever occurs first.

2. ELIGIBILITY. Open to legal residents of the 50 United States and District of Columbia, age 18 (or age of majority in entrant's state of residence, whichever is older), or older. Franchisees of Mail Boxes Etc., Inc., and The UPS Store® ("Sponsor") their respective employees and officers, parent and subsidiary companies and promotion and advertising agencies, including Alcone Marketing Group ("Administrator"), and entities involved in the printing, packaging and distribution of game materials (collectively "Game Entities") and the immediate families (spouse and children, siblings, parents and their spouses) and the members of the households of such individuals, whether related or not, are not eligible to enter or win a prize.

3. GAME CARDS. Game Cards will be distributed at participating locations of The UPS Store®, while supplies last, as follows:

• Customers who make a purchase of any amount at the counter will receive one Game Card. Limit one Game Card per customer per day.
• One Game Card per week (total of 4 cards during Game Period) will be inserted inside all active mailboxes at participating The UPS Store® centers during the Game Period.
• Select newspapers will also contain Game Cards (one Game Card per newspaper).

To obtain a Game Card without a purchase, mail a self-addressed stamped envelope (SASE) to: Perks & Paydays Game Card Request, P.O. Box 6645, Saddle Brook, NJ 07663 (VT residents may omit return postage). Requests must be postmarked by March 29, 2010 and received by April 5, 2010. Limit one request per day per household. Limit one mail in Game Card request per outside envelope. Sponsor and its agents are not responsible for late, lost, misdirected, illegible, incomplete, mutilated or postage due mail or Game Cards.

4. HOW TO PLAY. Gently scratch off the six mail boxes on the front of the Game Card. If three identical icons are revealed, you win the prize depicted in the icon, or will receive the discount offer depicted in the icon, subject to verification of the Game Card and your compliance with the Official Rules. Game Cards that do not include a prize award will include a discount offer. (See Rule 8 for details on how to claim a discount offer).

5. PRIZES/ARV/ODDS OF WINNING. A total of 1,600,300 prizes will be available (see table below). The total approximate retail value of all prizes is $1,373,556. Odds of winning a prize are: 1:12.  The odds of winning a particular prize are as provided in the table below:



6. TO VERIFY AND CLAIM A PRIZE. Winning Game Card is subject to verification and your compliance with the Official Rules. If you believe you have a winning Game Card for a prize (but not for a prize redeemable at The UPS Store® as indicated in Rule 5 above), mail in a first class stamped envelope the original Game Card and a 3" x 5" paper with your printed name, address, date of birth, daytime telephone to: Perks & Paydays Winner Claim, P.O. Box 6636, Saddle Brook, NJ 07663. Winning Game Cards must be received by May 7, 2010. It is recommended that you retain a photocopy of Game Card and send claim via certified mail, return receipt requested. After verification, winners will be notified by mail. Proof of mailing is not proof of verified winning claim. Prizes for services offered by The UPS Store® (50 Color Copies, 100 Black and White Copies, 5 Color Copies and 5 Black and White Copies) are to be redeemed in-store at a participating location of The UPS Store®. All black and white and color copies are restricted to 8.5" X 11", single sided, up to white 28# paper. Claims for prizes for services offered by The UPS Store® must be made at a participating The UPS Store® location by July 2, 2010. Claimants will be required to surrender the winning Game Card. Unclaimed instant win prizes will not be awarded. Limit of one prize per person.

7. PRIZE CONDITIONS. Upon verification of winning Game Cards for Grand Prize, Alarm System, Laptop, Business PC, LCD-TV, Hawaii Vacation, Small Office Makeover and Private Jet prizes as well as selected other instant win prizes (to be determined by Sponsor in its sole discretion), claimant will be required to complete and sign an Affidavit or Declaration of Eligibility as appropriate and a Liability Release and, where lawful, a Publicity Release to be returned within a time specified in the notification letter. Failure to timely return completed and signed document or return of any correspondence regarding the prize shall cause prize to be forfeited. Winner of Alarm System will be required to sign an ADT Small Business Services Contract and will receive the free alarm system, free installation and one (1) year of free monitoring. After the one year free monitoring the Contract may be terminated by the customer without penalty. An IRS Form 1099 will be filed to the Internal Revenue Service with a copy to the winner as appropriate for all prizes valued at $600 or over. Travel guests of winners for the Hawaii Vacation and Private Jet prizes ("Travel Prizes") must execute a Liability Release and, where legal, Publicity Release within a specified time prior to the issue of travel documents. If travel guest is a minor, parent/legal guardian must confirm and sign release documents. Travel Prizes are subject to airline and hotel (for Hawaii Vacation Prize only) availability, and restrictions and blackout dates apply. Travel must take place by March 27, 2011 and on dates and times approved by Sponsor or prize will be forfeited. Sixty (60) days advance notice is required for air and hotel (as applicable) reservations. Confirmation will be given on a space-available basis only. Once a reservation has been confirmed, no changes are permitted. Reservations and airline tickets are non-refundable for cash or credit, non-transferable and non-changeable once issued. If lost, they will not be replaced. Travel Prize winners and travel guests must travel on same itinerary and on dates and at times approved by Sponsor. Actual value of Travel Prizes will vary depending upon winners' residence and time of travel. Gift Cards are subject to terms of use of issuer. Service not included with cell phone prizes. Cell phone models may only operate on certain carrier networks, which may or may not be compatible with entrant's existing network, if any. Standard terms and conditions of vendor or provider apply to any services provided as part of a prize. Remaining Prizes (except for prizes for services redeemable at The UPS Store® as indicated in Rule 5 above): Upon verification of Game Card, prize will be sent to winner by regular or express mail. All Prizes: Return of any prize as non-deliverable for any reason will cause prize to be forfeited. Prize winners are responsible for all expenses not specified relating to acceptance and use of prize and any federal, state or local taxes on prize. Prize is not transferable. No prize substitution, except by Sponsor in its sole discretion.

8. DISCOUNTS/HOW TO CLAIM A DISCOUNT:

The overall odds of receiving a discount are 1:1.1.
All discount offers must be redeemed in-store at a participating location of The UPS Store®. Game Card must be surrendered at the time of discount offer redemption. The 20% off total purchase discount offer applies to all products and services, excluding UPS and USPS products, notary service, money orders/transfers, and metered mail. All black and white and color copies are restricted to 8.5" X 11", single sided, white 28# paper.

9. SECOND CHANCE DRAWING.A random drawing will be held on or about May 21, 2010 to award the Grand Prize if unclaimed. To enter drawing, on a 3" x 5" paper hand print name, address, date of birth and daytime telephone number and mail in first class stamped envelope to: Perks & Paydays Second Chance Drawing, P.O. Box 6635, Saddle Brook, NJ 07663 for receipt by March 29, 2010. Only one entry per stamped envelope. No mechanically reproduced entries. Odds of winning depend upon whether the one Grand Prize is unclaimed, and number of eligible entries received for drawing. Second Chance Drawing winner will be notified by mail and will be required to complete the prize claim process stated for the Grand Prize in PRIZE CONDITIONS above.
10. GENERAL. By participating, participants agree (a) to official rules and decisions of Sponsor and its agents, including the administrator, which decisions shall be final; (b) to release discharge and hold harmless Game Entities and their respective directors, officers and employees and agents from any and all liability, claims, losses and damages, regardless of the cause, arising out of their participation and the acceptance and use of a prize or redemption of a discount offer; (c) that Sponsor and its agents have made no representation, warranty or guaranty, expressed or implied, relative to a prize, including its quality or fitness for use; and (d) if a prize winner, to the use by Sponsor and its agents of their name, likeness, picture and city of residence for advertising, promotional and publicity purposes, without additional compensation or prior review, in any and all media, now known or to be developed; and upon request will provide specific written consent to any use as requested by Sponsor. Game Card is void if not obtained from authorized and legitimate channels, or if the Game Card is, in whole or in part, illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained via fraud or theft. Sponsor and its agents are not liable for printer errors or issuance of any void, misprinted, or irregular game piece resulting from production or packaging problems or errors. Liability for an irregular Game Card is limited to providing another Game Card, while supplies last, subject to verification of original Game Card irregularity. In the event production, seeding, printing, human or other errors cause more than stated number of prizes and/or discounts to be available and/or claimed, Sponsor reserves the right either to (a) award the prizes (except for the four prizes redeemable at The UPS Store® as indicated in Rule 5 above) and/or discounts by random drawing among all eligible claimants who submitted legitimately received valid Game Cards, or (b) terminate game with notice and award prizes (except for the four prizes redeemable at The UPS Store® as indicated in Rule 5 above) in a random drawing among eligible claimants who submitted legitimately received valid Game Cards or (c) conduct the Game and make all prizes available to be won and offer all discounts in a manner deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. In no event will Sponsor be liable for awarding more than the stated number of prizes or discount offers. Sponsor and its agents are not responsible for any typographical or other errors or mistakes in the printing or dissemination of advertising and promotional material or these official rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual who it determines is not in compliance with these rules or attempts to corrupt or impair the honest and legitimate conduct of the game.

The game shall be governed by the laws of the State of California applicable to promotions fully carried out within; and any action, suit or proceeding shall be brought and held only in a federal or state court located within the County of San Diego, California. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorney's fees or costs; and under no circumstances will any individual be permitted to obtain awards for punitive, consequential or incidental damages; and entrants hereby waive any and all rights therefore and of any right to have damages multiplied or otherwise increased.
